Tort Drug Litigation
Since 1906, the U.S. Food and Drug Administration (FDA) has been responsible for protecting public health through the regulation and supervision of all pharmaceutical drugs. The FDA regulates more than $275 billion in drugs and an additional $18 billion in vitamin supplements. Unfortunately, although the FDA does all it can to test drugs before they are given to consumers, unsafe drugs still manage to get approved and released to the public, including people in St. Louis.
Before any drug is given approval by the FDA, it is seriously scrutinized in a procedure called New Drug Application (NDA). This process takes an average of 7.3 years, during which extensive studies are done on the drug. After the FDA approves an NDA, the drug is able to be marketed and sold to consumers across the U.S. and in St. Louis. A drug that is approved by the FDA is said to be "safe and effective when used as directed."
A manufacturer is then required to report every time a patient experiences adverse affects of a drug within 15 days of learning of its occurrence. The FDA also receives reports about adverse drug events through its MedWatch program.
Approval can be given to unsafe drugs if clinical trials for the drug are not big enough to determine such issues as increased risks for contracting rare diseases. There has also been much criticism of the FDA as allegations of ties with drug companies have been widely reported, as well as instances of members involved in drug approval studies receiving financial compensation from drug manufacturers who would be affected by the results of the study.
Drug Litigation Lawsuits
By definition, a tort is "a wrongful act other than a breach of contract for which relief may be obtained in the form of damages or an injunction." St. Louis tort drug litigation deals with lawsuits against pharmaceutical drug manufacturers when it is found a drug they have produced may have dangerous, if not deadly, side effects. Famous tort drug litigation lawsuits include those involving Fen Phen, Fosamax, Cipro, Ketek, Zyprexa, and Chantix. St. Louis tort drug lawsuits can also be brought against companies when it is found the company was aware of potentially severe or fatal side effects but failed to notify the public or recall the product and take it off the market.
Drug manufacturers must be held liable for any injuries their products cause.
