Food Recall

The Food and Drug Administration (FDA) regulates the majority of the consumable products that are allowed in the marketplace. This is an immensely difficult task, as there are so many new food products that are added to the market every day. It is common for potentially dangerous products to make it into the marketplace without being properly tested or regulated. Today's market is particularly complex because of the substantial amount of food products that are imported from other countries. When a food product causes illnesses or injuries, the FDA will have to conduct an investigation and the food manufacturer may be forced to recall defective, dangerous, or contaminated product.

Food Recalls

A food product will only be recalled if enough people are injured to merit an investigation and the investigation establishes a link between the food contamination and the injuries or illnesses suffered by consumers. This typically involves a particular batch of food made between certain dates that have become contaminated. In other instances, the entire line of a product may be recalled.

Examples of Recent Food Recalls

There are many food recalls that take place nationwide every week. Here are a few examples of the most recent recalls reported by the FDA:

  • Slimming Capsules and Coffee: Intercharm Inc had to recall Slim Forte on July 25, 2011, for undeclared sibutramine, a weight loss medication.
  • Fruit: Agromod Produce Inc had to recall their papayas in July because they contained salmonella bacteria. Eagle Produce had to recall their cantaloupe for the same reason.
  • Fish: Euphoria Fancy Food Inc recently recalled their herring because they contained clostridium botulinum, a bacterium. TGF Production had to recall their herring fish in salt water for similar contamination.
  • Vegetables: Evergreen Fresh Sprouts, LLC had to recall their sprouts due to salmonella contamination.
  • Salad: Dole recently had to recall their salads for having listeria monocytogenes, one of the most virulent food borne pathogens that can result in wrongful death.
  • Cheese: Quesos CentroAmericano Corp had to recall their Queso Fresco because it contained Staphylococcus aureus. Prior to that, Atlanta Corporation had to recall their Royal Blue Stilton cheese because it was contaminated by listeria monocytogenes.

Defective Labeling

It is common for food manufactures to improperly label their products. This type of error can result in serious injury or illness if the consumer is allergic to the ingredient not listed on the label. Sun Vista recently had to recall its Red Enchilada Sauce for not listing soy on the label. Similarly, Whole Foods had to recall some of their pies that contained milk and some of their croissants for not declaring eggs as an ingredient. The listing of ingredients is particularly important to consumers who have food allergies.

Rights of Injured Victims

Anyone injured or made ill by a recalled food product may file a product liability claim against the at-fault manufacturer. Damages that may be covered include hospital bills, lost wages, and past and future suffering. An experienced attorney can help those who have suffered due to contaminated and/or recalled products determine the value of their potential Missouri injury claim.
