As a result of the increasing number of tractor trailer wrecks, large truck collisions, and other commercial motor vehicle accidents, the federal government created the Federal Motor Carrier Safety Regulations (FMCSR.) The FMCSR are laws that certain truck drivers and truck companies must follow when operating their tractor trailers.
For instance, there is a law in regard to the amount of time a truck driver can drive without a break. This law exists because operating a large truck while tired or fatigued is extremely dangerous. These laws are called the Hours-of-Service. Truck companies typically do very little to prevent this dangerous behavior.
An experienced Missouri personal injury attorney who handles truck accident cases will look to see if any of the laws were violated in your case. A violation of these laws could lead to liability for the truck company and the truck driver. The tractor trailer driver and the truck company are supposed to keep a log book that details the hours-of-service. These logs can help determine if any of the laws were broken.
